What is a rental agreement in car or scooter hire?

A rental agreement is the contract between you and our company. It sets out the terms and conditions of the rental. You’ll sign it before we hand over the vehicle key to you. Renter, if more than one, undertake jointly and separately all obligations deriving from the contract and they shall cover them towards the owner.  These are usually included in a rental agreement according to the law: the details of the Lessee, breakdown of rental fees, car or scooter hire details (registration number) and rental period details. Renter has to keep the contract inside the car during the duration of the hiring.

How old do I need to be to rent and which are the driver’s requirements to rent?

To rent a car from our company your driving license must be issued at least 12 months prior the rental and is required to be type B. An international driving license is required for all rentals unless rental is a citizen of a European Community Country. The driver must be at least 21 years old.

How I can use the rented vehicle?

Only the lessee is allowed to drive the car and it is prohibited that the car is used for any other use, such as indicatively: a) any third party driving it without participating in the contract,  b) subleasing to third parties,  c) towing other cars, vehicles, trailers, etc., d) carriage or movement heavy objects, flammable materials, chemicals, slobbery or smelly objects, drugs, weapons, as well as any other substances prohibited by the laws, or materials which can put in danger the safety of the car and its occupants, and/or any third parties,  e) driving it, if the driver is fatigued or has consumed any amount alcohol or any other substance that may affect, at least at his/her ability to drive, or for any other reason, f) driving it, in violation of any traffic rules, customs or other applicable legislation or driving the car in dirt roads.  Especially, the carriage of the car by boat is permissible only upon prior written approval of the lessor.

In any case, the lessee is obliged to using carefully the car, taking all reasonable and necessary measures ensuring the smooth and orderly operation of the car, locking and guarding the car by making use of its security systems and taking all reasonable steps to prevent theft or reduce of its value for any reason. The lessee is forbidden to make any repairs and interference at the car, or allow any third party to do so, for whatever reason, without the prior written consent of our company.

What is the insurance policy for renting cars?

All our cars are automatically covered for third party liability as required by law without any extra cost. If an accident is caused by the renter, the insurance company will pay for repairs to the damaged party. But the repair of the rented car is fully paid by the renter. If he is not the responsible party, then the damage to his car will be paid by the guilty party’s insurance company. The third party liability includes:

What is covered:

  • Cover third parties in case of body injuries up to 1.220.000€  (Third parties are considered to be  the passengers of the both cars, except of the driver of the rented car who caused the accident)
  • Material damages to the third parties up to 1.220.000€
  • Damages from a vehicle without insurance up to 30.000€
  • Death or injury to the driver up to 12.000€
  • Legal Protection up to 15.000€

 

What is not covered:

  • Damage to the rental vehicle
  • Theft of personal belongings from the vehicle
  • Damage caused to the underneath and the top of the car, the antenna, the mirrors and the tires.
  • Damage caused as a result of a breach of the rental agreement’s terms and conditions.
  • Replacement of Keys

 

As for the repairs of the rented car in case of an accident that is caused by the renter and in order to reduce your responsibility for any damages, we offer you two options:     

Α) Collision Damage Cover (CDW ή LDW) / Excess: 400 Euros / Cost:  5 Euros per day

Collision Damage Cover with 400,00 Euros excess amount means that if the client has an accident which he is responsible for, the Maximum amount that he will have to pay is the excess amount, on the supposition that the terms of the car rental agreement are observed

Examples for a car with 400,00€ excess:

Α) For an accident that causes damage equal to 100,00€, the client will be charged 100,00€.
Β) For an accident that causes damage equal to 2000,00€, the client will be charged 400,00€.

What is not covered:

  • Theft of personal belongings from the vehicle
  • Damage caused to the underneath and the top of the car, the antenna, the mirrors and the tires.
  • Damage caused as a result of a breach of the rental agreement’s terms and conditions.
  • Replacement of Keys

B) Zero Excess / Super Cover / Full Insurance / Cost: 10 Euros per day

If the rental car is damaged by a car accident you will be covered for the total cost of the repairs of the rental car, the renter does not pay anything on the supposition that the terms of the car rental agreement are observed.

What is not covered:

  • Theft of personal belongings from the vehicle
  • Damage caused to the underneath and the top of the car, the antenna, the mirrors and the tires.
  • Damage caused as a result of a breach of the rental agreement’s terms and conditions.

What are the required procedures for picking up the car?

You will be required to present your driver’s license (of all drivers) and passport for verification purposes and to sign the Rental Agreement when you pick up the vehicle. Once completed, you should pay the sum determined by the contents of the agreement. (Payment must be settled when the vehicle is picked up / Does not apply to users who have paid in advance).

A short explanation of the vehicle will be provided, and the vehicle will be checked for existing scratches or other damages and for the level of the fuel tank, together with the user. The rental vehicle can be used as soon as the inspection has been completed. The execution of the contract is considered to be a receipt for the delivery of the vehicle. The collection of the car can take place anywhere on the island and at any time you want, outside of opening hours as well, without any extra cost.  You can pick up the rental car from 09.00 am.

What do I need to keep in mind when returning the vehicle?

A member of our team will be waiting for you at the place you have choose to leave the vehicle. The lessee is obliged to deliver the rental vehicle to the lessor at the exact place and time specified on the contract, in the condition and with the same quantity of fuel the vehicle had when the lessee received it.

The condition of rental vehicle: If any damage in the rental car is attributed exclusively to the driver’s fault, the renter is obligated to pay our company right away and without any objection the amount of the damage and the expenses regarding the loss of the use. If the renter has accepted anyone special packet of insurance then the responsibility of the renter is limited according to the certain packet of insurance. If any damage takes place, please inform us as soon as possible.

Fuel: If, based on the relevant indicator on the dashboard of the car, there is any difference in the quantity of the fuel the vehicle has at its return to the lessor compared to the quantity it had at its delivery to the lessee, the lessee shall pay in euro the amount that corresponds to the difference of the fuel that must be completed as at the time of the return of the vehicle to the lessor.

Drop off time: In case you intend to return the car with a delay, we kindly ask you to inform us in advance. In case of a reasonable difference between car receipt and return, you will not be charged an extra day. In case the lessee delays to deliver the car to the lessor without advance notice by the lessee, the lessor may seek directly to pick it up by all lawful means civil and criminal procedures and with the car being able to be regarded as stolen or displaced and uninsured. In any case, the lessee is obliged to pay the additional daily rent corresponding to the days of delay in the delivery of the car. You have to  drop off the rental car by 09.00 am.

The rental vehicle may be returned to the same place you are collecting or to another location without any extra charge.  Also, you can return the rental vehicle at any time you want and outside of opening hours as well.

Can I arrange for the car to be delivered to a hotel?

Yes, you can without extra fee.

Can I return the car to a different place from the collection position?

Yes, you can without extra fee.

Will there be petrol in the car?

According to the fuel policy, the car must be returned to us with the same amount of fuel you received it. During car delivery to you, we will check the fuel indicator together and the amount of fuel will be noted on the rental contract. The company is not required to refund the renter in case he returns the car with excess fuel.

What is the policy for off road driving?

It is strictly forbidden to drive Diakomihalis Travel & Shipping Agency / Rent a Car & Moto vehicles off road.

What is the policy of the payment?

20% deposit of the total amount is required in order to reserve the car and full payment when you have signed the contract. You can pay by credit card or by cash.

What is the policy of the cancellation?

The client can cancel until 45 before arrival and the deposit will be refunded. All cancellations will bear any bank fees we have incurred. Cancellations made in 44 days before arrival 100% will be charged.

What is the kilometer policy?

Unlimited kilometers.

Will I be charged for extra drivers or for infant seats?

There will not be any charge for extra drivers or for infant seats.

What is included in the rental price?

Can i pay by credit card?

The rental of the car is paid by Cash or Credit Card. Payment by credit/debit card can be realized with no extra charge. We do not accept American Express.

What do I have to do in case of an accident or mechanical problem?

In case of an accident or mechanical problem, you have to contact our office immediately using the phone numbers we will have provided during car delivery. 

Infringements & fines: In case a fine is imposed (e.g. due to illegal parking) and/or an administrative infringement of the lessee is addressed by the competent authorities, the lessee must notify such event to the lessor when returning the vehicle and, in any case, within 24 hours from the time such infringement is addressed by the authorities; and/or from the imposition of the fine and/or any other kind of penalty. 

When can a contract be terminated?

 In the event where the lessor becomes aware, in any way, that the vehicle is driven unlawfully or by infringing any of the terms of the contract, the lessor has the right to terminate the rental at any time. The termination of the agreement results automatically in the termination of the vehicle rental and the renter must return the rental vehicle to the owner.
